Winning and collecting are different events. A judgment is a piece of paper that says you are owed money; turning it into money requires the debtor to have assets you can reach, and often another round of process.
That is why the honest question is not "would I win?" but "what is this worth after fees, my own time, and the chance of collecting nothing?"
The step people skip
Check whether the debtor has anything worth collecting before filing. A business still trading, with a bank account and receivables, is collectible. A dissolved entity with no assets is not, and a judgment against it is a souvenir.
Cheaper moves first
- A demand letter with a deadline resolves a large share of disputes at the cost of a stamp.
- If the client is a business with a licence, a complaint to the licensing body sometimes moves faster than a court.
- For larger balances, selling the debt or hiring a contingency collector converts a low probability of full payment into a certain fraction of it.
